Booking Conditions

1. Freedom Holidays Ltd., 'The Agency', act as an accommodation letting agent for the person or company offering the accommodation for renting, 'The Owner'.

2. Once the holiday confirmation has been issued, the accommodation contract is between the holidaymaker and the Owner. All bookings are subject to these booking conditions. Bookings can be regarded as firm only when written confirmation has been issued by the Agency.

3. A deposit of £50 per person is payable on bookings made more than eight weeks before the commencement of the holiday. Insurance premiums are payable at the time of booking. Within eight weeks, the full amount of the holiday is payable. Money change costs will be billed to the client. In the event of a booking not being accepted, such deposit and insurance premium will be refunded without delay. No reason need be given by the Agency for the rejection of any booking application. Some accommodation and dates will be let only to clients booking their travel arrangements through Freedom Holidays, or to clients paying a supplement. Upon payment of the deposit and subject to the acceptance of the booking, the applicant shall be liable for the balance of the cost of the holiday for the full period booked, including any ancillary services provided. If the balance payment due is not settled by the due date an administration charge of £10 will be added to the account (no reminders will be sent). The Agency reserves the right to levy a charge of £25 for each and every change made by the client after the holiday confirmation has been issued, subject to the change being possible. If a change of property is requested the charge will reflect the costs incurred by the agency by way of lost deposits or guaranteed payments to accommodation providers. Deposits are non-returnable and non-transferable. All costs, charges or increases in respect of services supplied by outside agencies are the responsibility of the client.

4. Very occasionally it may be necessary to make a material alteration to the holiday arrangements for reasons of overbooking or the unexpected removal of an accommodation from our lists. In this event, the Agency will endeavour to offer alternative accommodation at the brochure price of the new property or a full refund of monies paid. The Agency will be under no further obligation for any losses, or expenses arising from these alterations. Neither will the Agency be under any liability or obligation for any alterations or cancellation caused by civil strife, strikes, sickness, bad weather, technical transportation problems or other circumstances amounting to a force majeure, or the non disclosure of material information by the holidaymaker.

5. All tickets and vouchers are issued by the Agency as under the conditions and regulations of the companies supplying the service.

6. The Agency makes all statements and gives all information in good faith and uses its best endeavours to check, so far as it is reasonably able, all information given to applicants.The Agency shall not be liable for any damage or loss resulting from information given or statements made whether orally or in writing provided that such information is given or statements made in good faith. You must check the Errata section of the brochure.

7. The Agency does not own, control or maintain any of the accommodation offered and makes no warranties as to the state or condition of any accommodation and shall be under no liability in respect of such rentings, or the terms or conditions thereof, nor shall the Agency be liable for any act, neglect or default on the part of the Owner or for any loss, damage, expense, accident, injury or inconvenience, whether to persons or to property which the applicant or any other person may suffer or sustain arising out of or in respect of any application, or any such renting or otherwise howsoever. Photographs may show part or all of the self catering accommodation. In some cases a general view of the establishment is shown, not the buildings in which the self catering accommodation is housed. All descriptions are subjective and reflect only the personal opinion of our inspector or that of the owner. It must be understood that the accommodations in our program mostly form part of the owners' personal property or farm and the vagaries of the situations must be taken into account by the client. Absolute peace and quiet or privacy cannot be guaranteed. All distances shown are measured in a straight line.

8. These terms may not be varied nor waived except in writing by a Director of the Agency. Any questions, matters or disputes arising out of any agreements shall be governed by the laws and customs of Jersey. If, in the opinion of the holidaymaker, the accommodation is unsatisfactory and there are grounds for complaint, the holidaymaker must first bring his complaints to the notice of the owner or key holder. If, after these steps have been taken, satisfaction is not obtained, the matter should be reported to the Agency. No correspondence will be entered into regarding matters not brought to the Agencies attention by the holidaymaker during the holiday period, while the client is on the island.

9. The number of persons occupying the accommodation must not exceed the number arranged at the time of booking.

10. The holidaymaker undertakes to behave in a reasonable manner at all times whilst in and around the accommodation, to make good any damage caused, fair wear and tear excepted and to leave the property in the same state of cleanliness in which it was found. The Owner or persons acting on his behalf must be allowed access to the property at any reasonable time during the renting period.

11.
To ensure that the accommodation is properly prepared outgoing clients must vacate by 10 am. Ingoing clients may take possession at 2 pm. These times may vary.

12. Insurance cover under the Freedom Holidays Ltd. scheme is compulsory. Clients declining the cover will have their booking rejected or cancelled. Insurance premiums are payable at the time of booking. (These booking conditions cancel all previous issues.)
